Can I copy from television and radio?

Most tertiary institutions have a licence with Screenrights that allows staff to copy anything they like from radio and television, without having to obtain permission or pay individual fees. Copying must be done for the educational purposes of the institution.

What is Screenrights?

Screenrights is a non-profit company whose members include producers, distributors, writers, music copyright owners and other rights owners in film, television and radio.

Under provisions in the New Zealand Copyright Act, Screenrights licenses educational institutions including polytechnics, colleges of education and Wananga to copy material from radio and television for educational purposes.

The institution pays a fee that covers all copying for the year. The money that we collect is distributed to the rights owners in the material you tape after the deduction of our administrative overheads only.

What can I copy under a Screenrights licence?

You can tape any programme from any television or radio channel. This includes both pay and free to air stations. There are no limits on the amount of a programme you can copy, nor on the number of copies you can make. Programmes can also be copied at home or in the institution.

The only requirement is that the copying must be for the educational purposes of the institution. This includes copying programmes to screen as part of a course or the keep in the library as a resource.

You should also note that the licence does not cover the copying of pre-recorded material, such as bought or hired videos. Copying this material without permission from the copyright owner may infringe copyright.

With a Screenrights licence, you can:

  • Copy any programme, anytime, anywhere
  • Copy entire programmes or excerpts
  • Make copies of copies
  • Copy in any format - VHS, CD, DVD, hard disk
  • Show copies in class
  • Keep copies in the library as a resource

To help you get the most out of your Screenrights licence, we can email you a weekly television guide divided into different learning areas with information about upcoming programmes relevant to the areas in which you teach.

To subscribe to the guide, email tvednz@screenrights.org with your name and the name of your institution.

Do we have to label copies?

Any copies you make under the licence must be labelled with the name of the institution for which the copy was made, the title of the program, the date of the broadcast and the date on which the copy was made, if this is different. For example :

Do we have to keep records of everything we copy?

No. Screenrights does monitor taping in order to determine who needs to be paid. However, we recognise that keeping a record of everything you copy would be administratively onerous. For that reason, Screenrights monitors copying by means of a statistical sample. When your institution is selected to be surveyed you will be required to keep records for a short period. You will be notified prior to the survey taking place and full training will be given to all key staff. The rest of the time you do not need to keep any records of the programmes you copy.
